GMind Terms and Conditions

Please read these terms carefully before using GMind's application, website, dashboards, games, and related services.

Welcome to GMind. These Terms and Conditions, also referred to as the “Terms” or “Agreement,” govern your access to and use of the GMind mobile application, website, dashboards, educational games, software, content, and related services collectively referred to as the “Services.”

The Services are operated by GMind, referred to in these Terms as “GMind,” “we,” “our,” or “us.”

By creating an account, purchasing a subscription, accessing the Services, distributing student access codes, or allowing a student to use GMind, you agree to be bound by these Terms. If you are using GMind on behalf of a school, educational institution, company, or other organization, you confirm that you have the authority to accept these Terms on behalf of that organization.

If you do not agree to these Terms, you must not access or use GMind.

Service Description

GMind is an educational mobile platform that provides a library of interactive, 3D educational Unity games for students. The platform is designed to support learning through gameplay, educational challenges, progress tracking, and digital learning experiences.

GMind may include:

  • Interactive 3D educational games.
  • Unity-based learning experiences.
  • Student access codes.
  • Parent dashboards.
  • Teacher dashboards.
  • School administration dashboards.
  • Educational analytics and reports.
  • Student progress tracking.
  • Game assignments.
  • Subscription management.
  • Technical support and related services.

GMind may update, improve, modify, remove, or replace parts of the Services from time to time.

Eligibility and User Types

GMind is intended for use by students, parents, teachers, schools, and school administrators.

The main user roles are:

Students use GMind to access assigned educational games and learning experiences.

  • Students

Parents may create accounts, manage subscriptions, supervise student use, manage student profiles, and review educational progress.

  • Parents or Legal Guardians

Teachers may manage classrooms, distribute student access codes, assign games, and review student progress.

  • Teachers

Schools may manage teachers, classrooms, student access, reporting, and institutional use of GMind.

  • Schools and School Administrators

Students may only use GMind under the authorization and supervision of a parent, legal guardian, teacher, or school.

Account Registration and Account Security

Parents, teachers, and school administrators may be required to create an account to access certain parts of GMind.

You agree to:

  • Provide accurate, complete, and current information.
  • Keep your login credentials confidential.
  • Not share your account with unauthorized persons.
  • Promptly update incorrect or outdated account information.
  • Notify GMind immediately if you suspect unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.

GMind is not responsible for losses caused by your failure to maintain the confidentiality of your account credentials, access codes, or administrative permissions.

Student Access Codes

Students access GMind through unique access codes generated or provided by GMind, parents, teachers, or schools.

Access codes are:

  • Unique to the assigned student or authorized use case.
  • Intended only for the student or group for whom they were issued.
  • Not transferable.
  • Not for resale.
  • Not to be publicly posted or shared online.
  • Subject to security controls, including device binding.

Device Binding

Student access codes are strictly bound to the first device on which they are entered or activated, unless GMind provides an authorized reset or transfer process.

This device lock is used to protect student accounts, prevent unauthorized access, and reduce misuse of paid or school-issued access codes.

Users must not attempt to:

  • Bypass device binding.
  • Share access codes with unauthorized users.
  • Use the same code across multiple unauthorized devices.
  • Modify, spoof, or manipulate device identifiers.
  • Use technical tools to avoid access restrictions.
  • Resell, trade, publish, or distribute access codes.

GMind may suspend or disable access codes, devices, or accounts that violate these Terms.

Responsibilities of Teachers and Schools

Teachers, schools, and school administrators are responsible for the proper management of their GMind accounts and student access.

Teachers and schools agree to:

  • Maintain the confidentiality of their accounts.
  • Distribute student access codes securely.
  • Provide access codes only to authorized students.
  • Ensure students use GMind for educational purposes.
  • Manage classroom and student information responsibly.
  • Ensure that teachers, staff, and administrators use GMind only within their authorized roles.
  • Notify GMind promptly of unauthorized access, misuse, or compromised access codes.
  • Comply with applicable laws, school policies, and privacy obligations.
  • Obtain any required parental permissions or school authorizations where applicable.

Schools are responsible for determining whether GMind is appropriate for their educational programs and for ensuring that institutional use complies with applicable educational, privacy, and student data rules.

Student Responsibilities

Students must use GMind only for educational purposes and in accordance with instructions from their parent, teacher, or school.

Students must not:

  • Share access codes with others.
  • Use another student’s access code.
  • Attempt to access another student’s profile or progress.
  • Attempt to bypass device restrictions.
  • Interfere with games, dashboards, or platform security.
  • Use GMind for harmful, illegal, abusive, or unauthorized purposes.
  • Copy, extract, or misuse GMind content, games, or assets.

Parents, teachers, and schools are responsible for helping students understand and follow these rules.

Subscriptions and Payments

GMind may offer paid subscriptions, purchases, or institutional access plans.

Parents may subscribe on a:

  • Monthly basis, or
  • Annual basis.

Schools or institutions may purchase access under separate commercial terms, invoices, or written agreements where applicable.

Payment Processing

Payments may be processed through third-party payment providers, including:

  • Paymob.
  • Apple In-App Purchases.
  • Other payment providers made available by GMind from time to time.

By submitting payment information, you authorize GMind and its payment providers to charge the applicable fees, taxes, and other amounts due for your selected subscription or purchase.

GMind does not intentionally store full credit card numbers. Payment processing is handled by third-party payment providers subject to their own terms, policies, and security standards.

Automatic Renewal

Unless stated otherwise at the time of purchase, subscriptions automatically renew at the end of each billing period.

By purchasing a subscription, you authorize recurring charges for the selected subscription plan until the subscription is canceled.

The renewal period will match the original subscription period unless otherwise disclosed. For example:

  • Monthly subscriptions renew monthly.
  • Annual subscriptions renew annually.

You are responsible for canceling your subscription before the renewal date if you do not wish to continue.

Cancellation

You may cancel your subscription through the method used to purchase it.

For subscriptions purchased through Paymob or GMind’s direct payment flow, cancellation instructions may be provided through your account, dashboard, or customer support.

For subscriptions purchased through Apple In-App Purchases, cancellation must be managed through your Apple account settings. GMind does not control Apple’s subscription management process.

Cancellation stops future renewal charges but does not automatically refund amounts already paid, unless required by applicable law or expressly approved by GMind.

Refunds

Unless required by applicable law or expressly stated in a separate written agreement, GMind does not provide refunds or credits for:

  • Partial billing periods.
  • Unused time.
  • Unused access codes.
  • Failure to use the Services.
  • User error.
  • Device restrictions caused by breach of these Terms.
  • Subscription cancellation after renewal.
  • Account suspension caused by violation of these Terms.

Refund requests related to Apple In-App Purchases may be subject to Apple’s refund policies and procedures.

GMind may, at its sole discretion, issue refunds or credits in exceptional circumstances. Any such refund or credit does not create an obligation to provide similar refunds in the future.

Pricing and Changes to Fees

GMind may change subscription fees, pricing plans, billing models, or available features from time to time.

If pricing changes affect an active subscription, GMind will provide notice where required by law or platform rules. Continued use of the Services after a pricing change takes effect means you accept the new pricing, unless you cancel before the applicable renewal date.

Intellectual Property Ownership

All rights, title, and interest in and to GMind are owned exclusively by GMind or its licensors.

This includes, without limitation:

  • Educational games.
  • Unity projects and builds.
  • 3D assets.
  • Characters.
  • Animations.
  • Game mechanics.
  • Software code.
  • User interfaces.
  • Dashboards.
  • Databases.
  • Logos.
  • Brand names.
  • Visual identity.
  • Graphics.
  • Sound effects.
  • Educational content.
  • Reports and templates.
  • Platform design.
  • Documentation.
  • All related intellectual property.

These Terms do not transfer any ownership rights to you. You receive only a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended educational purpose, subject to these Terms.

Restrictions on Use of GMind Content and Software

You must not, directly or indirectly:

  • Copy, reproduce, modify, or create derivative works from GMind.
  • Reverse engineer, decompile, disassemble, or attempt to extract source code.
  • Scrape, crawl, harvest, or extract data from the platform.
  • Copy or reuse GMind’s games, 3D assets, graphics, characters, or educational content.
  • Sell, rent, sublicense, lease, distribute, or commercially exploit any part of the Services.
  • Use GMind’s trademarks, logos, or branding without written permission.
  • Attempt to bypass access controls, subscription limits, or device restrictions.
  • Use bots, scripts, emulators, automation tools, or unauthorized software to access the Services.
  • Remove copyright, trademark, or proprietary notices.
  • Use GMind to build a competing product or service.
  • Share access to GMind with unauthorized users.

Any unauthorized use of GMind’s intellectual property may result in suspension, termination, and legal action.

Acceptable Use Policy

You agree not to use GMind for any unlawful, harmful, abusive, or unauthorized purpose.

You must not:

  • Violate any applicable law or regulation.
  • Attempt to breach, test, scan, or bypass system security.
  • Access data, accounts, or systems without authorization.
  • Interfere with the operation of the Services.
  • Upload or transmit malware, viruses, or harmful code.
  • Attempt to overload or disrupt the platform.
  • Misrepresent your identity or affiliation.
  • Use GMind to harass, harm, exploit, or endanger any person.
  • Use the Services to collect unauthorized information about students or other users.
  • Circumvent subscription, payment, access code, or device restrictions.
  • Engage in fraud, abuse, or unauthorized commercial use.

GMind may investigate suspected violations and take appropriate action, including suspension, device bans, access code cancellation, account termination, or legal enforcement.

Data and Privacy

GMind’s collection, use, storage, and sharing of personal information is governed by our Privacy Policy.

By using GMind, you acknowledge that GMind may process personal information as described in the Privacy Policy, including student data, parent data, teacher data, school data, device data, payment-related data, and educational progress data.

Parents, teachers, and schools are responsible for ensuring that student information submitted to GMind is accurate, authorized, and provided in compliance with applicable laws and policies.

Educational Reports and Analytics

GMind may generate reports, dashboards, learning analytics, scores, progress summaries, and activity data based on student use of the Services.

These reports are intended to support educational decision-making. They are not intended to replace professional educational judgment, teacher assessment, psychological evaluation, medical advice, or formal academic certification.

Teachers, parents, and schools are responsible for interpreting reports appropriately and in context.

GMind does not guarantee specific academic outcomes, test results, grades, behavioral improvements, or learning achievements.

Availability and Updates

GMind aims to provide reliable access to the Services, but we do not guarantee uninterrupted or error-free operation.

The Services may be unavailable from time to time due to:

  • Maintenance.
  • Updates.
  • Technical issues.
  • Internet outages.
  • Third-party service provider issues.
  • Security incidents.
  • Force majeure events.
  • Platform store requirements.
  • Infrastructure changes.

GMind may update, modify, suspend, or discontinue any feature, game, dashboard, or part of the Services at any time.

Some updates may be required to continue using the Services.

Third-Party Services

GMind may rely on third-party providers for hosting, payments, messaging, email delivery, analytics, app store distribution, infrastructure, or other operational services.

These providers may include:

  • Paymob.
  • Apple In-App Purchases.
  • DigitalOcean.
  • Unifonic.
  • SendGrid.
  • Other providers selected by GMind.

Third-party services may be subject to separate terms and policies. GMind is not responsible for third-party platforms, payment processors, app stores, or external services outside our control.

Suspension, Termination, and Device Bans

GMind reserves the right to suspend, restrict, disable, or terminate access to the Services at any time if we reasonably believe that a user, account, access code, device, school, teacher, parent, or student has violated these Terms.

Grounds for suspension or termination may include:

  • Unauthorized sharing of student access codes.
  • Attempting to bypass device binding.
  • Use of access codes on unauthorized devices.
  • Payment fraud or chargeback abuse.
  • Unauthorized access to the platform.
  • Security violations.
  • Reverse engineering or scraping.
  • Misuse of student data.
  • Violation of intellectual property rights.
  • Violation of applicable law.
  • Abuse of support, accounts, systems, or other users.

GMind may ban, block, or restrict specific devices, App Install IDs, accounts, access codes, IP addresses, or user profiles in order to protect the platform and other users.

Termination or suspension does not limit GMind’s right to pursue legal remedies.

Effect of Termination

Upon termination or suspension:

  • Your right to access the Services may immediately stop.
  • Access codes may be disabled.
  • Student access may be restricted.
  • Dashboard access may be removed.
  • Subscription benefits may end.
  • Certain data may be retained as described in the Privacy Policy.
  • Payment obligations already incurred remain due.

No refund will be provided for termination caused by violation of these Terms, unless required by applicable law.

Disclaimer of Warranties

To the maximum extent permitted by law, GMind is provided on an “AS IS” and “AS AVAILABLE” basis.

GMind makes no warranties, express or implied, including without limitation warranties of:

  • Merchantability.
  • Fitness for a particular purpose.
  • Non-infringement.
  • Accuracy.
  • Reliability.
  • Availability.
  • Error-free operation.
  • Uninterrupted service.
  • Compatibility with all devices or networks.
  • Specific educational outcomes.

GMind does not guarantee that the Services will always be secure, available, accurate, complete, or free from bugs, errors, interruptions, or harmful components.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above limitations may not apply to you.

Limitation of Liability

To the maximum extent permitted by law, GMind and its owners, directors, officers, employees, contractors, partners, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes, without limitation, damages for:

  • Loss of profits.
  • Loss of revenue.
  • Loss of data.
  • Loss of goodwill.
  • Business interruption.
  • Educational disruption.
  • Device issues.
  • Unauthorized access caused by user negligence.
  • Subscription misuse.
  • Code sharing.
  • Inability to access the Services.
  • Reliance on educational reports or analytics.

To the maximum extent permitted by law, GMind’s total liability for any claim arising out of or relating to the Services or these Terms will not exceed the amount paid by you to GMind for the Services during the three months immediately before the event giving rise to the claim, or the minimum amount permitted by applicable law, whichever is greater.

Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless GMind and its owners, directors, officers, employees, contractors, licensors, partners, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • Your use or misuse of the Services.
  • Your violation of these Terms.
  • Your violation of applicable law.
  • Your infringement of intellectual property or other rights.
  • Your unauthorized sharing of access codes.
  • Your failure to secure account credentials.
  • Your unauthorized submission or misuse of student data.
  • Your breach of school, parent, or institutional responsibilities.

This clause applies only to the extent permitted by applicable law.

App Stores and Platform Terms

If you download GMind from the Apple App Store, Google Play, or another app marketplace, your use of the app may also be subject to that platform’s terms and conditions.

In the case of conflict between these Terms and the applicable app store terms, the app store terms may apply only to the extent required by that platform.

Apple, Google, and other app stores are not responsible for providing support or maintenance for GMind unless required by their own terms.

Changes to the Services

GMind may modify, improve, update, suspend, discontinue, or remove any part of the Services at any time.

This may include changes to:

  • Games.
  • Learning content.
  • Dashboards.
  • Reports.
  • Pricing.
  • Access rules.
  • Device binding rules.
  • Subscription features.
  • Platform availability.
  • Supported devices.
  • Supported operating systems.

GMind is not liable for changes to the Services, except where required by applicable law or a separate written agreement.

Changes to These Terms

GMind may update these Terms from time to time.

If we make material changes, we may notify users through appropriate methods, such as:

  • In-app notice.
  • Email notice to parents, teachers, or school administrators.
  • Website notice.
  • Dashboard notice.

The updated Terms will include a new “Last Updated” date. Continued use of GMind after an update means the Services will be governed by the updated Terms, except where additional consent is required by law.
